A MAN who sexually assaulted a teenager when they fell asleep in the same bed after a party was spared jail.
Graham Roberts, 21, went to the party in Wirral last November with the 19-year-old and her sister, leaving around 4am.
They went back to another flat on Clarendon Road, Wallasey, and stayed up drinking until about 5am before all three agreed to sleep in the same bed.
The victim woke to find Roberts sexually assaulting her.
Neville Biddle, prosecuting, said: “Her sister, who had a boyfriend, said she didn’t want to sleep next to Graham Roberts so the girl volunteered to sleep in the middle.
“She said we can sleep in the bed but that is as far as it goes. She did not condone any sexual activity.”
Roberts, of Palm Hill, Oxton, admitted what he had done to police but later pleaded not guilty to two counts of sexual assault.
He pleaded guilty as his trial was about to start.
Judge John Roberts gave Roberts a 12 month prison sentence suspended for a year, ordered him to do 300 hours unpaid work, and imposed a three month curfew.
